Terms & Conditions

The vehicles of Bahía Rent a Car S.L. and Daily Rent a Car S.L., hereinafter Bahía/Daily, may only leave the autonomous community of Andalusia with prior authorization and must be returned to our offices.

In order to make a reservation request you are obliged to accept the terms and conditions.

Important: All our vehicles are manual transmission, therefore, in case of the slightest doubt on the part of the clientele about the ability to drive a manual car we ask to be communicated to us immediately in order to be able to offer an adequate solution.

The clutch of a vehicle is not covered by any accident protection insurance option, with the clientele being fully responsible for its repair.

Requirements:

  • Minimum age of driver is 23 years old, with driver’s license more than 2 years old.
  • Credit card is required for payment. We do not accept American Express, Maestro, cash payment, Paypal or wallet cards.
 

The rental price includes:

  • 300 Kilometers per rental day.
  • C.D.W. or third party accident protection insurance with excess (value of the vehicle).
  • Compulsory civil liability.
  • Voluntary civil liability, 50.000€.
  • It is a fundamental and essential requirement for the accident protection insurance without excess (RELAX) to comply with the regulations and legislation in force regarding traffic and circulation.
  • 24-hour roadside assistance.
  • VAT.
  • Vehicles may be replaced by others of similar characteristics.


Notes and clarifications regarding accident protection insurance:

The cars are compulsory with C.D.W. or third party accident protection insurance with excess (value of the vehicle), this means that the lessee or payer is responsible for any damage to the vehicle.

How can the CDW or third party accident protection insurance with excess (value of the vehicle) be cancelled?

Option A: By contracting the SCDW with excess or third party accident protection insurance with excess (depending on the type of vehicle, this being lower than the value of the vehicle).

Option B: Taking out the RELAX or accident protection insurance without excess. With this option of accident protection insurance does not mean that the client has carte blanche to make damages to the car or to give a vexatious treatment to the same one, there are certain limits.

Situations that are in no case covered by the RELAX accident protection insurance:

Crashing into a wall. Damaging the clutch by not knowing how to drive a manual car correctly. Not knowing how to drive correctly in traffic circles and causing an accident. Accidents due to ignorance of the highway code. Low of the car. Leaving the road. Rollovers. Refueling errors. Loss, breakage, theft and damage to keys. Guilty negligence and misuse of the vehicle. Acts of vandalism. Tire damage. Vehicle interiors. Scratching the car with branches and bushes. Staining the car with creams or lotions.

In case of not taking SCDW with excess or RELAX, a deposit of 500€ will be charged as a security measure and guarantee, which will be returned once the vehicle is returned undamaged and in the same conditions as it was delivered.

In case of not taking any extra accident protection insurance option, i.e. choosing the CDW third party insurance, the client or the payer will be responsible for all damages to the vehicle, being in charge of all breakdowns, repairs and/or towing service.

In case of taking the option of third party accident protection insurance with excess, i.e. choosing the SCDW accident protection insurance with excess, the customer or the payer shall be liable for all damages to the vehicle up to the value of the excess.

In the event that the vehicle suffers blows, scratches, accidents or damage, the client is obliged to fill out a friendly accident report and in any case to take as many photographs as necessary, license plates of the vehicles involved and/or telephone numbers/e-mails to help clarify the facts. If this is not done, the client will be charged with all the expenses incurred for the repair of the vehicle and any other expenses required by the insurance companies, since any accident protection insurance option that may have been contracted will become invalid and without effect, and the insurance will be terminated. 

Damage caused by vandalism, adverse weather conditions such as falling/starting objects or strong gusts of wind, as well as damage caused by improper use of the vehicle, are not covered by any accident protection insurance option. In these cases, the customer or the payer will be responsible for them, and will have to pay for the complete repair of the damage.

In the event of a collision, collision, accident or damage to the vehicle, it is compulsory to fill out a friendly accident report or accident declaration and report any claim to Bahia/Daily. Failure to do so will invalidate any accident protection insurance option that may have been taken out and render it null and void.

In the event of failure to comply with the regulations and legislation in force regarding traffic and circulation, in the event of an accident or damage to the Bahia/Daily vehicles, any accident protection insurance option shall be void and the customer or the payer shall be responsible for the same, and shall be liable for the complete repair of the damage.

The customer is obliged to return the vehicle on the date and at the time specified in the contract. If he/she wishes to extend the rental period, he/she must contact Bahia/Daily. Under no circumstances can the amount deposited as a deposit be used to extend the rental period, so if the extension is accepted, the client must make an additional payment for it. If the extension cannot be extended due to vehicle availability or for any other reason, the client must return the vehicle at the date, time and place indicated.

 

 

The rental price does NOT include:

  • Car deliveries in Sanlucar de Barrameda, Chipiona, Costa Ballena and Rota have a charge of 20€ not contemplated in the reservation request.
  • Fuel tank. Full-full policy.
  • Baby seats and booster, 8€ per day.
  • Delivery charge for out of office hours on working days 15€. On Saturdays after 13:30 the amount of the fee will be increased by 15€. Sundays and holidays the amount of the fee will be increased by 15€.
  • Traffic fines, towing, penalties or error in fuel refueling and associated costs.
  • In case of accident or damage to Bahia/Daily vehicles for not respecting or complying with current traffic regulations and legislation, any accident protection insurance option will be void.
  • Additional driver 6€ per day.
  • 40€ for processing penalties that will be charged to the client’s credit/debit card once the company receives notification of the penalty.
  • In the event of non-cooperation on the part of the person responsible for a violation in identifying the driver responsible for the violation, Bahia/Daily reserves the right to charge the customer’s credit/debit card for the full amount of the fine plus a 50% surcharge. In the event that you provide incorrect, incomplete or false personal data, Bahia/Daily will initially assume the amount of any fine, penalty or amount that the customer may incur against third parties, being entitled to subsequently collect such amounts through the means of payment provided by you without prejudice to exercise the appropriate legal actions to claim such amounts.
  • In the event that the infraction involves the loss of points, for each point lost, Bahia/Daily reserves the right to charge the customer’s credit/debit card 100€ per point.
  • Extra kilometer from 300km/day, 40 cents.
  • If the vehicle is excessively dirty when it is returned, the customer will be responsible for the associated costs.
  • It is forbidden to put animals in the cars and to stain the car with creams or lotions.
